General Conditions of use of the Rentalia.com website


Legal terms applicable to the users of the web page of Rentalia Holidays S.L. (hereinafter Rentalia or the Portal). This Document is a translation of the only valid Legal Terms written in Spanish that you may find in http://es.rentalia.com/common/warning.cfm.

1. Object of the Legal Terms.
These Legal Terms regulate the conditions, access and use of the Portal, its content and services, either paid or free of charge, provided to the users; such term includes the customers as well as the owners of accommodation and services promoted in the Portal.

2. Acceptance of the Conditions of the Legal Terms.

2.1. User Status.
Mere access and/or use of the Portal, or of all or part of the contents and services provided therein, gives the person concerned "user" status and implies full acceptance, without reserves, of the Conditions of the Legal Terms stated in the published version, from the moment the user accesses them. These shall be accepted by the mere fact of visiting the pages of the Portal and this will definitely be the case when the services offered on the Portal are used.

The User declares he or she is of legal age and has the legal capacity to enter into binding agreements and undertake the conditions of the Legal Terms detailed herein.

2.2 General Rules of Use.
The user is obliged to use the Portal in a diligent and correct manner. The user must address other users of the Portal respectfully.

The user is obliged (not limited) not to send advertisements of any kind and communications of a commercial or advertising nature, or any other type of unauthorised mass mailing ("spam").

2.3 Modification of these Legal Terms
These Legal Terms may be subject to periodic updating or modification. In that case, the user will be subject to the new terms of use of the Portal.

3. Content and services provided through the Portal.
RENTALIA consists of merely informative pages that offer compilations, over the Internet, of contents and services related to the world of tourism, in addition to complementary services and facilities that are accessible by Internet. RENTALIA reserves the right to modify, increase or cancel the presentation and configuration of the Portal at any time, without advance notice, as well as the contents and services included therein.

4. Cookies and other Devices.
The user hereby authorises RENTALIA to use cookies. The Portal uses cookies to facilitate browsing, customise information and analyse the effectiveness of the web site. Should you not wish to receive cookies from Rentalia you are asked to configure your browser for it to request your approval before storing a new cookie on your terminal.

5. Responsibility for access and use of the contents and services of Rentalia.
Access to the Portal, as well as the use the User may make of it, is the exclusive responsibility of the person doing so. Thus, the user agrees to accept the consequences, damages and/or losses that may arise from that access or use of the services offered by RENTALIA. RENTALIA shall provide all the means available to provide the user a good service through its web page. Notwithstanding the above, RENTALIA shall not be responsible for damages and losses, or any other item as follows:

i. Availability and continuity.
RENTALIA does not guarantee the availability and continuity of operation of the pages and of its services at all times.

ii. Veracity, exactness and updating.
RENTALIA does not guarantee the veracity, exactness and updating, at all times, of the content and services on the page. All the information concerning the services or accommodation offered to the Users on the Portal is provided solely for the purposes of information. The information provided by RENTALIA has been prepared from data bases available to the public, from the data provided by the actual accommodation owners, the data provided by other service providers and by the users of the Portal themselves. RENTALIA will not be made responsible for the content, veracity and updating of that information. Users shall not publish any contents attempting against the rights of others.

iii. Privacy and security.
The user shall abstain from causing, by any means, any destruction, alteration, cancellation or damage to the data, programs or electronic documents of RENTALIA, of its providers or third parties, as well as from introducing or distributing on the Network any programs, viruses or any other physical or electronic instrument that may cause or be liable to cause any type of alteration of the Network, of the system or of the equipment of RENTALIA or third parties. It is expressly forbidden to carry out any kind of activity or practice that breaches the principles of good conduct generally accepted among users of Internet.
RENTALIA does not guarantee the privacy and security of the page, and is not responsible for intervention by unauthorised third parties on it, nor for the appearance of viruses and similar in its system or computer media.

iv. Services provided by third parties.
RENTALIA does not guarantee the veracity, exactness, updating, privacy, security, availability and/or continuity of the contents and/or services by third parties that are exhibited directly on its page, or to which access is available through links, banners, buttons, etc.
RENTALIA is not a service intermediary; it solely and exclusively provides the information service just as it appears on the Portal. The Users must contact the owners directly. RENTALIA shall not be a party to such hiring and shall not be made responsible for the quality, content or availability of the services one may wish to hire or have hired.

v. Opinions and others
Likewise, the user shall abstain from any conduct through RENTALIA that may breach the intellectual or industrial rights of RENTALIA or third parties, or that may violate or detract from the honour, personal or family privacy or image of third parties, and shall exonerate RENTALIA in the event of claims, in and out of court, that may be brought against it due to such conduct.

The "users" may give their opinions, be they positive or negative, concerning the accommodation and others. Rentalia shall not publish remarks or opinions that are a manifest breach of the honour, personal or family privacy of third parties. RENTALIA shall not be made responsible, nor guarantees the veracity and exactness of the opinions that may be expressed by the users of its Page.

vi. Legal Information and other Recommendations.
RENTALIA may make model contracts and/or other legal documents available to "users" and/or may make miscellaneous recommendations in the forums. RENTALIA offers this information for informational purposes only and wishes to make it plain that this Company is not a specialist in legal or any other kind of advice. RENTALIA accepts no responsibility for updating the information contained in the Portal or for the use made of same by the "users".

vii. Sundry
The user undertakes not to use the content and services of RENTALIA to perform or suggest activities prohibited by moral standards or the legal regulations, expressly agreeing to ensure RENTALIA is exonerated of any liability related to the quality, exactness, reliability, correctness or morality of the data, programs, information or opinions, whatever their origin, included in the Web Page.

The content, software, images, sounds, texts and photographs of RENTALIA or other third parties provided on the Web Page are protected by Legislative Royal Decree 1/1996, of the Intellectual Property Act. The contents are especially protected, pursuant to Article 12 of the said Royal Decree, as data collections. It is absolutely forbidden to reproduce, distribute, publicly disclose and transform that property without express written authorisation from RENTALIA.
Unauthorised use of this intellectual property by third parties shall give rise to liabilities of a criminal and/or civil nature and others as established by law. RENTALIA shall not be held responsible for breaches by the user of the Web Page that affect third party rights.

7. Linking
Establishment of links to RENTALIA does not imply any acceptance or relation whatsoever between the page that establishes it and RENTALIA. RENTALIA authorises linking to the Portal as long as the following conditions are fulfilled:
- this is reported by telephone or e-mail (telephone: 91 523 31 04 or e-mail: info@rentalia.com)
- the origin and destination of the link is reported, as well as the text describing it
- the text describing that link is reported.

One may not declare that RENTALIA has authorised that link, nor shall inexact or false representations be made concerning RENTALIA, its services or the Web Page; nor shall links be made to other pages that may exhibit illicit content and/or those that are contrary to public moral or order.

8. Protection of personal data
RENTALIA provides the user these legal terms in order for the user to be able to decide whether it is convenient to register in any of the data bases kept in automated files included in the pages of RENTALIA.
The personal data of the users who decide to register in the relevant data base shall be used, among others, for statistical purposes, to redefine the services the page offers, for maintenance and management related to the user, as well as for the tasks of information, training and/or dispatch of technical, operational and commercial information concerning products and services related to the page.

RENTALIA complies with the rules on Protection of Personal Data. In this sense, RENTALIA has taken the required security measures and has registered its data bases on the Data Protection Agency Register. Should RENTALIA cede the personal data to a third party, it would proceed pursuant to the laws in force, respecting the rights of the holder. The users shall have all the rights they are granted under the applicable laws; among others, they shall be entitled to consult, modify and cancel their personal data, or to be informed when these are ceded to third parties.
The party responsible for the Data Bases will be RENTALIA HOLIDAYS S.L. which may be located at its offices in Madrid- 28013, Gran Vía 31 - 9º 1º.

9. Termination
RENTALIA may interrupt or cancel the Portal or any of the services offered to the users, at any time and without prior notice. In all cases, the Company may interrupt the service provided to any user who makes unethical, offensive, illegal or incorrect use of the content or services of RENTALIA and/or which is contrary to the interests of this Company.

10. Force Majeure
Force Majeure shall be considered any event or circumstance beyond the control of the parts, or any other contingency that may not be foreseen, or if foreseeable, that is inevitable according to the stipulations and jurisprudence of Article 1,105 of the Civil Code. If the service forming the object of this contract is interrupted due to causes of Force Majeure, that service shall be suspended during the time and to the extent that is justifiable.

11. Notifications
RENTALIA may notify the user either by electronic mail or by postal mail; likewise, the user may address his or her correspondence to the Web Page by means of the postal address: Madrid- 28013, Gran Vía 31 - 9º 1º or by telephone: +34 91 523 31 04 or by e-mail:
info@rentalia.com .

12. Applicable law and jurisdiction
The parts, renouncing their own jurisdiction, if that is possible, submit to the Courts and Tribunals of Madrid, Spain. Spanish Law shall be applicable.
