Service conditions


You, as the Owner or authorized representative (referred to hereinafter as the "Owner") of a holiday property (referred to hereinafter as the "accommodation"), and Rentalia share a common goal: promoting your property and providing traveler satisfaction (referred to hereinafter as "the customers"). We are working together as partners to make the “accommodation” you are offering better known and to provide "the customers" with top-quality service. Turning our thoughts to travelers, you and we see things the same as regards building the best possible channel for promoting "the accommodation" your are offering.

We would therefore like to propose the following contract to you:

In the event of accepting the following Terms, the "Owner" shall be entitled to access the promotion plans offered by Rentalia for promoting the "accommodation" and shall be expressly accepting the conditions set forth in the legal warning (www.rentalia.com/common/warning.cfm) which you must read carefully before going any further (all of which is referred to as a whole as "the Contract").
Said promotion plans are detailed at www.rentalia.com/Owner/prices.cfm. These promotion plans are addressed exclusively to "vacation" type properties which meet the legal and quality requirements for offering their services.
All of the other services Rentalia offers for “Owners” and travelers at www.rentalia.com (tourist or beach information, forums, etc.) are free of charge, these terms not being applicable thereto. For further information on these services, you may refer to the legal warning published at www.rentalia.com/common/warning.cfm.

Concerning the promotion plans:

- Rentalia undertakes to furnish the "Owner" with access to the data on the "accommodation" being offered thereby and to make whatever photo changes may be requested thereby for the purpose of editing or updating these photos.

- Rentalia shall provide the "Owner", at the request thereof, with passwords to be able to directly modify part of the information published on the "accommodation" corresponding to the contract thereof. The "Owner" must safeguard and keep these passwords secret and shall be liable for whatever use is made of said passwords.

- Rentalia has adopted very strict measures for keeping the service available nearly 100% of the time. Nevertheless, due to the inevitable technical limitations, Rentalia shall not be liable for any possible future temporary interruption of the service. In the improbable case of an interruption of more than one week in length, Rentalia will compensate the "Owner" with an additional week of contracted promotion.

- Rentalia reserves the right to make a selection, based on its own criteria, of accommodations which may be offered and be published on the Rentalia website.

- The "Owner" must furnish true, accurate information concerning the characteristics of the "accommodation" being offered thereby on the website. The "Owner" takes full responsibility for the information published and undertakes to keep this data updated at all times.

- The "Owner" authorizes Rentalia to verify the information published, and for the purposes of expediting the use of the website, to reduce and edit the information published concerning the "accommodation".

- To provide better customer service, the "Owner" undertakes to further detail and expand upon the information published by Rentalia, at the request thereof, either by phone or mail.


Use of the information furnished to Rentalia by "the user"

Rentalia shall be entitled to carry out additional promotional endeavors to promote the "accommodation" offered by the "Owner" in media other than the website www.rentalia.com (i.e. other websites, publications, Internet search engines, etc. targeting potential customers). The "Owner" authorizes Rentalia to use the data furnished to convey the same to third parties for the publication and dissemination thereof.
In accordance with Law 34/2002 (LSSI), the "Owner" expressly authorizes Rentalia to send him/her marketing messages and the promotional offers related to this service.


Customer comments, opinions and voting

We share a common goal: Promoting the "accommodation" the "Owner" has to offer. Travelers' opinions are key to the success of the Rentalia website and to your booking numerous reservations or customers through Rentalia.
When evaluating customer comments or opinions, Rentalia must respect their freedom to think and say as they wish.

- Therefore, the "Owner" and Rentalia accept leaving what customers have to add flow freely, whether on the plus or minus side, with regard to the "accommodation". Those opinions which manifestly cast a slur upon the honor of the "Owner" or third parties shall not be published.

- Rentalia is not responsible for the customers’ opinions or comments or for any possible damages sustained as a result thereof. The customers making comments must identify themselves and are recorded in the Rentalia files. However, by virtue of the Personal Data Protection regulations, Rentalia is not authorized to provide any personal details on the "Customers" without their permission or an order from the competent judicial or administrative authority.

- The "Owners" may reply to what any customer has had to say on the condition they identify themselves with the name the "Owner" and of respecting the same conditions which are required of the comments made by the customers.


HTML codes

Rentalia authorizes the "Owner", and so advises the same from the start, to incorporate the html codes provided by Rentalia on his/her own webpage without any modification whatsoever thereof being allowed, with the exception of those related to their format as regards the color and font. Rentalia reserves the right to deny the "Owner" the use of said codes, especially any Owner making unauthorized changes.


Specific Terms and Conditions

- The different formalities which must be completed for making the contract are clearly explained in the "Add Your Accommodation" section (http://www.rentalia.com/owner/newproperty.cfm). Rentalia will be electronically filing the data configuring The Contract. For pinpointing and correcting errors, you may e-mail Rentalia. The contract may be formalized in Spanish and/or in English, German, French, Portuguese, Italian or other languages, the sole valid version, in this case, being the Spanish version.

- The "Owner" may engage the specific promotions shown in the section www.rentalia.com/owner/prices.cfm. Whatever paid promotions the "Owner" may engage shall be run for the length of time stated under the aforesaid section commencing as of the date engaged, following the acceptance of their request by Rentalia, the date of which shall be stated in the mail and on the invoice Rentalia will send to the "Owner".

- The promotions offered free of charge may be removed or modified by Rentalia at any point in time without prior notice. Likewise, the "Owner" may request being removed from these promotions at any time.

- When the corresponding Contract reaches an end without any prior denouncement having been made by either party, it shall be understood to have been extended.

- Rentalia reserves the right to revise the price or other terms and conditions of any of the promotions without prior notice. In such a case, the automatic extension shall not be applicable, Rentalia being under the obligation of requesting acceptance of the new terms and conditions on the part of the "Owner". The new terms and conditions shall enter into effect as of the end of the period engaged by the "Owner".


Early termination

The contract shall be terminated early if either of the parties were to commit a major breach of any of the obligations set forth under the Contract, the aforesaid major breaches including, among others:

- That the "Owner" provide manifestly inaccurate information on the website or fail to tell the truth regarding the characteristics of the "accommodation", and/or that the same refuse to allow the free flow of what is said by the customers with regard to the "accommodation" thereof.

- That the "Owner" not make the payment for the promotions engaged with Rentalia or that it delay making said payment by more than five days.


Force Majeure

Force Majeure is considered as being any event or situation beyond the control of the parties or any other contingency which is unforeseeable or which, being foreseeable, is inevitable in accordance with the stipulations and case law of Article 1105 of the Civil Code. If, for reasons of Force Majeure, the service comprising the object of this contract were to be interrupted, said obligation would be suspended throughout the full length of time and to the extent which were to be justifiable.


Temporary efficacy of terms

The present terms, as well as the Legal Warning may be amended at any time. Any possible future amendments of the terms shall solely enter into effect as of the end of the period engaged under the contract.
In the event of amendment, the automatic extension shall not be effective, Rentalia being under the obligation of sending the Owners a link to the new terms.


Jurisdiction and Venue

The parties hereto, waiving their own codes of law, if possible, submit to the Courts and Tribunals of Madrid (Spain). This contract shall be governed by Spanish Law.
