Service conditions

You, as owner or legal representative (hereinafter “the Owner") of a holiday rental (hereinafter,” the Accommodation"), and RENTALIA HOLIDAYS, SL (hereinafter “Rentalia”) share a common objective: the promotion of your accommodation and the satisfaction of travellers (hereinafter “the Traveller") which in other words means the publishing and better public awareness of the Accommodation which you offer and the providing of a better level of service to Travellers. In relation to the Traveller, together we coincide in building the best possible channel of promotion for the Accommodation on offer

We therefore propose the following Contract:

If the following Conditions of Service are accepted, the Owner can access the promotion plans offered by Rentalia to promote the Accommodation and will be expressly accepting the conditions found in the Legal Notice (www.rentalia.com/legal.php), which must be read carefully before continuing as well as any of the forms which must be completed in order to contract this service (all of which shall be known as "the Contract"). Those terms in capital letter which are not defined in the current Conditions of Service will be assigned the definition contained in the Legal Notice.

The promotion plans are found in www.rentalia.com/owner/prices.php. The promotion plans are directed exclusively at Accommodations of a “holiday" rental nature that comply with the necessary requirements to be able to offer this service.

The current Conditions of Service will not be applied to other services which are offered free of charge to the Owner and/or the Traveller by Rentalia in the Website (tourist information, beaches, forums, etc.) to which the Legal notice will apply.

In relation to the Contract:

- Rentalia agrees to give the Owner access to the Contents of the Accommodation which have been entered by the latter and to carry out any changes to these that the Owner may request.

- Rentalia will provide the Owner, if requested, with the access codes to be able to directly modify the Contents of the Accommodation which have been entered by the latter. The Owner must keep safe and preserve the confidentiality of the access codes and will be responsible for the use that is made of these.

- Rentalia has adopted very strict measures to maintain the service available almost 100% of the time. However, due to inevitable technical restrictions, Rentalia will take no responsibility for the temporary interruption of the service. In the improbable event of an interruption lasting more than one week, Rentalia will compensate you with an additional week on your contracted promotion.

- Rentalia reserves the right to carry out the selection of the Accommodation that can access the Website using quality criteria and internal control.

- The Owner must provide both truthful and accurate information on the characteristics of the Accommodation offered in the Website. The Owner will be responsible for the information and Contents they have published.

- The Owner permits Rentalia to restructure the information and the Contents published by the latter with the aim of facilitating the use of the Website and the information published on the Accommodation.

- In order to give the Traveller a better service, the Owner agrees to regularly update the information on the Accommodation and to provide details and extra information on the information published in the Website and requested by the latter, by telephone, email or any other means.

The use of the information given to Rentalia by the Owner and the Protection of Personal Data

With regard to the contents of the Protection of Personal Data regulations, Rentalia informs the Owner of the existence of a data file of a personal nature which may contain personal details regarding the Owner and which has been obtained through the Website and/or is used for statistics, the redefining of the services offered, for the safety in the quality control, maintenance and management of the business and legal relationship that links the latter with RENTALIA, as well as, where necessary, the sending of Newsletters (free subscriptions) and/or commercial or promotional communications.

The Owner expressly accepts the inclusion of the data collected during their visit to the Website, or provided by filling in any of the forms, as well as the data from commercial contacts stored with Rentalia, in the automated data file of a personal nature which has been referred to herein. During the data gathering process, and in each area of the Website in which this data is requested, the Owner will be informed whether this data is mandatory or not in the offering of services by Rentalia, either by hyperlink or by inclusion of the aforementioned personal data in the actual form.

Furthermore, by accepting this Contract, the Owner agrees to the use of their personal data in the sending of commercial and informative communications by Rentalia (by any means, including email, SMS, etc.) with regard to the services offered by Rentalia.

Rentalia may carry out additional promotional tasks of the Accommodation offered by the Owner in other external means other than the Website (for example, other web pages, digital or physical publications, Internet search engines, etc. directed at potential travellers). The Owner authorizes Rentalia to use the given Contents and to pass them on to third parties with the aim of promoting the Accommodation. In these cases, if deemed necessary, the interested party shall be informed and their consent shall be requested for the possible distribution of their personal details.

The Owner may demand their legal rights with regard to the data that has been collected as expressed in the previous section, in accordance to the regulations on the protection of data of a personal nature, and especially the right of access, modification or cancelation of the data and their opposition whenever it is considered pertinent. Rentalia has introduced technical and organizational measures in compliance with the required safety levels laid down by the Safety Measures Regulations and approved by the Real Decreto 994/1999 of June 6. Nevertheless, it is not possible to guarantee the technical security in such a means of communication like the Internet, given that this is not impenetrable and there may be leaks due to third party attacks.

Traveller – Owner Contact (Users)

Rentalia has introduced a quality control system for the Accommodation found in their Website. Therefore, Rentalia presents recommendations for a satisfactory rental and warnings of caution directed at the Users, which you declare you are aware of and accept (http://es.rentalia.com/travellers/consejos.php). Rentalia may present new recommendations and introduce new control measures directed at facilitating a satisfactory rental between the Travellers and Owners, free of any irregularities and fraud. Some of these current and future measures will require that you provide documentation regarding the truthfulness of the information offered, relating to the ownership, conditions and location of the Accommodation to increase the reliability of the latter. The Owner is obliged to present this documentation when requested by Rentalia. Among other measures, every Accommodation that has been published for less than (12) months in the Website will have a “be careful” warning. The Owner can have this warning removed from their Accommodation by complying with any of the following conditions or others that Rentalia may introduce in the future:

As part of the Website quality control system, the Website permits the communication via email between the Traveller and the Owner through their own web domain (rentalia.com). These emails will be assigned exclusively to the management of the holiday rental or the service it refers to, expressly forbidding the use of these for restricted personal activities in which there may be an expectation of privacy or secrecy in the communications. The use of Rentalia.com email will enable Rentalia to notify the Owner and/or Traveller of those cases in which the holiday rental or service that is being contracted or consulted through this means does not comply with the internal quality control criteria contained in the Website system, and therefore Rentalia can warn the Owner and/or Traveller of a potential risk, irregularity or fraud.

If this warning were to be given or if the Accommodation does not comply with any of the internal quality control criteria, the Accommodation may be removed immediately from the Website, and reinstated if the Owner presents the compliance with the Rentalia quality control requirements.

At all times Rentalia will not intervene nor will it be responsible for the contracting of the services between the Owner and/or Traveller and takes no responsibility for the decisions taken after consulting the information found in the Website.

Comments, opinions, photos, videos and Travellers’ votes

We have a common objective: the promotion of the Accommodation that the Owner offers. The opinions, images, videos and other Content entered by the Travellers are a key element for the success of the Website and for you to receive the booking or contacts with Travellers through Rentalia.

When it comes to evaluating the Contents or opinions of the Traveller, Rentalia must respect their freedom of speech and opinion.

- Therefore, the Owner and Rentalia agree not to create any impediment in the comments from Travellers, whether they be negative or positive, regarding the Accommodation. Rentalia does not intervene in the Contents written by Users which are sent directly and under the exclusive responsibility of these, although they may remove those comments that do not comply with the conditions expressed in section 3.b of the Legal Notice.

- Rentalia is not responsible for the comments or opinions from Travellers or the possible damages by these. The Travellers that enter the opinions or Contents must previously identify themselves and are registered in the Rentalia files. Nevertheless, in virtue of the personal data protection regulations, Rentalia is not authorized to pass on personal details of Travellers without their consent or the request from a legal judicial or state authority.

- The Owner can reply to any opinion from a Traveller, on the condition that they identify themselves with their Owner name and respect the same conditions which are required from the Travellers’ comments.

HTML Codes

Rentalia gives the Owner permission, by prior request, to include the html codes provided by Rentalia in their own web page, without making any modification of these, except those that refer to the colour and font. Rentalia reserves the right to deny the Owner permission to use these html codes and especially those who carry out non authorized modifications.

Specific conditions.

- The different procedures that have to be followed to complete the contract are clearly outlined in the section: "Registering an accommodation" (http://www.rentalia.com/owner/newproperty.cfm). Rentalia will store the data found in the Contract in digital format. If you wish to identify and correct the errors, you can send Rentalia an email. The contract can be in Spanish and/or English, German, French, Portuguese, Italian or other languages, nevertheless the only valid version being the first.

- The Owner can contract the specific promotions that appear in the section www.rentalia.com/owner/prices.php. The promotions requiring payment that can be contracted by the Owner have the duration of the period of time stipulated in this section from the moment of the contracting and after the acceptance of your request by Rentalia, and the starting date will be indicated in the email and invoice that Rentalia sends the Owner.

- The free promotions can be removed or modified by Rentalia at any time and without prior warning. Furthermore, the Owner may request their exclusion from these promotions at any time.

- At the end of the corresponding Contract, this will be extended, unless any of the parties decide otherwise.

- Rentalia reserves the right to review the price or other conditions of any of the promotions without prior warning. If this is the case, the automatic extension will not take place, and Rentalia must request the acceptance of the new conditions by the Owner. The new conditions will only take effect starting from the end of the period contracted by the Owner and from the expiry of the period contracted by the Owner.

Early termination

The contract shall undergo an early termination if any of the parties commit any serious non-compliance of the obligations found in the Contract, considering, among others, as serious non-compliance the following:

- That the Owner publishes information which is manifestly inaccurate in the Website or that the characteristics, location or ownership of the Accommodation are falsified in any way;

- That, if required by en caso de ser requerido por Rentalia at any particular moment throughout the duration of the current Contract, the Owner does not provide the documentation regarding the veracity of the information offered regarding ownership and conditions of the Accommodation.

- That the Owner refuses to provide unhindered access to the comments, opinions or Contents of Travellers with regard to the Accommodation.

- That the Owner does not make the payment of the promotions contracted with Rentalia or delays these payments more than 5 days.

Force Majeur

A Force Majeure is considered as being any event or circumstance which is not subject to the control of the parties involved or any other adversity that cannot be foreseen, or, if it is foreseeable, it is inevitable according to the terms and case law of Article 1.105 of the Código Civil. If the service which is the object of this contract is interrupted because of a Force Majeure, this obligation will be postponed for a time that is considered justifiable.

Applicable jurisdiction and law

The parties, expressly waiving their own jurisdiction, submit, if possible, their cases to the Courts and Tribunals of Madrid (Spain). The applicable Law is that of Spain.
